1. OVERVIEW

These Terms of Service (“Terms”) govern your use of services provided by Dental Wellness Clinic (“we”, “us”, “our”), including in-clinic treatments, consultations, and use of our website (if applicable).

By booking an appointment, receiving treatment, or using our services, you agree to be bound by these Terms.

2. ELIGIBILITY

By using our services, you confirm that:

  • You are at least 18 years old, or accompanied by a parent/legal guardian
  • You are legally capable of consenting to dental treatment under South African law

3. MEDICAL AND PROFESSIONAL DISCLAIMER

  • All treatments and advice are provided by qualified dental professionals
  • Treatment outcomes may vary from patient to patient
  • You are responsible for providing accurate and complete medical history

Failure to disclose relevant health information may affect treatment outcomes, and we will not be held liable for complications arising from undisclosed conditions.

4. APPOINTMENTS AND CANCELLATIONS

  • Appointments must be scheduled in advance
  • We require at least [24 hours] notice for cancellations or rescheduling
  • Late cancellations or missed appointments may incur a fee

We reserve the right to reschedule appointments due to unforeseen circumstances.

5. FEES AND PAYMENT

  • Fees for services will be communicated prior to treatment where possible
  • Payment is due immediately after services are rendered unless otherwise agreed
  • We may accept medical aid, but patients remain responsible for any shortfalls

Failure to settle accounts may result in further action in accordance with South African law.

6. MEDICAL AID / INSURANCE

  • Claims to medical aid schemes can be submitted on your behalf where applicable
  • Approval of claims is subject to your provider’s rules
  • You are responsible for any amounts not covered

7. PATIENT RESPONSIBILITIES

You agree to:

  • Follow all post-treatment care instructions
  • Attend scheduled follow-up appointments where necessary
  • Treat staff and other patients with respect

We reserve the right to refuse treatment in cases of abusive or inappropriate behaviour.

8. LATE ARRIVALS

  • Patients arriving late may have their appointment shortened or rescheduled
  • Full consultation or treatment fees may still apply

9. EMERGENCIES

Dental Wellness Clinic will make reasonable efforts to accommodate emergency cases, but availability cannot be guaranteed.

If you experience a serious medical emergency, please seek immediate care at the nearest hospital.

10. LIMITATION OF LIABILITY

To the extent permitted by South African law:

  • We are not liable for indirect or consequential damages arising from treatment
  • Liability is limited to the cost of the service provided

11. PRIVACY AND POPIA COMPLIANCE

We are committed to protecting your personal and medical information in accordance with the Protection of Personal Information Act (POPIA).

Patient records are kept confidential unless disclosure is required by law or consent is provided.

12. INTELLECTUAL PROPERTY

All materials, branding, and content associated with Dental Wellness Clinic remain our intellectual property and may not be used without permission.

13. CHANGES TO TERMS

We may update these Terms from time to time. Updated versions will be available at the clinic or on our website.

14. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of South African courts.
